  • Momentum Coach Inc. ("Momentum Coach," "we," "us," or "our") is a Canadian professional advisory business based in Ontario. Momentum Coach provides non-clinical, non-legal advisory services, including behavioural strategy, grief- and trauma-informed communication planning, litigation-support coordination, client-readiness support, estate-adjacent coordination, transition support, documentation support, organizational advisory, training, and professional collaboration support.

    Momentum Coach collects, uses, discloses, retains, and protects personal information in accordance with the Personal Information Protection and Electronic Documents Act, applicable provincial privacy requirements, Canada’s Anti-Spam Legislation, applicable consumer protection requirements, and our contractual obligations to clients and retaining professionals.

    Momentum Coach is not a law firm, health clinic, regulated psychotherapy practice, psychological assessment practice, financial institution, accounting firm, or fiduciary office. Momentum Coach does not provide legal advice, psychotherapy, psychological assessment, diagnosis, treatment, medical advice, financial advice, tax advice, accounting advice, estate trustee services, fiduciary services, or emergency crisis response.

    Although Momentum Coach does not provide regulated legal, clinical, medical, or fiduciary services, the nature of our advisory work may involve sensitive personal, family, legal, financial, health-related, occupational, cultural, organizational, and reputational information. We therefore apply heightened confidentiality, access-control, and retention practices.

    Documents and materials, including timelines, correspondence, summaries, records, professional communications, organizational documents, client-prepared materials, lawyer-directed materials, or other documents provided for advisory, organizational, or coordination purposes.

    Website and technical information, including IP address, browser type, device information, approximate location data, website usage, referring pages, pages viewed, interaction data, cookies, analytics data, and similar technical information.

    Marketing information, including newsletter sign-up information, email preferences, consent records, event registration information, resource downloads, and unsubscribe records.

    Momentum Coach may disclose personal information where required or permitted by law, including where necessary to comply with a court order, legal process, lawful request, regulatory obligation, tax obligation, accounting obligation, insurance requirement, or professional advisory requirement.

    Momentum Coach may also disclose information where reasonably necessary to protect safety, prevent harm, respond to suspected fraud, address abuse or harassment, collect unpaid accounts, enforce agreements, protect legal rights, manage a conflict of interest, or respond to a serious service-risk concern.

    Clients are asked to provide only the information necessary for the relevant purpose. Momentum Coach may request that unnecessary sensitive information not be provided or that communications be redirected through a more appropriate channel.

    Momentum Coach uses and discloses personal information only for the purposes for which it was collected, for related purposes that a reasonable person would consider appropriate, with consent, or as otherwise permitted or required by law.

    Momentum Coach retains personal information only as long as reasonably necessary for service delivery, client communication, legal compliance, accounting, tax, insurance, professional, evidentiary, business-continuity, dispute-resolution, and record-management purposes.

    Retention periods may vary by record type and engagement type. Intake inquiries that do not become client matters may be retained for a shorter period. Client records, invoices, written agreements, service notes, counsel-directed work product, and records connected to sensitive or disputed matters may be retained for a longer period where required to protect legal rights, preserve record integrity, comply with tax or accounting obligations, support professional continuity, or respond to future disputes.

    When personal information is no longer required, Momentum Coach will securely delete, destroy, anonymize, or archive the information with restricted access, as appropriate.

  • Momentum Coach treats certain information as sensitive even where it is not regulated health information or legally privileged information. Sensitive information may include information about legal matters, family disputes, grief, trauma, health, disability, finances, employment, business operations, reputation, children or youth, litigation, professional conduct, personal safety, cultural identity, or other personal circumstances.

    Momentum Coach does not require clients to provide medical records, diagnostic information, therapy records, legal pleadings, court records, financial statements, or other sensitive records unless the information is reasonably necessary for the stated advisory purpose and the client, retaining professional, or authorized representative has approved its use.

    Clients should not submit highly sensitive information through public website forms, ordinary email, text message, social media direct message, or unsecured channels unless they accept the associated risk and the information is necessary for Momentum Coach to assess fit or provide services.

    Momentum Coach uses safeguards appropriate to the sensitivity of the information. These may include password protection, access limitation, restricted disclosure, administrative controls, secure payment processors, secure platforms where available, confidentiality practices, device security, file organization controls, and record-management procedures.

    No website, email system, video platform, cloud platform, scheduling tool, payment processor, telecommunications system, or digital service can be guaranteed to be completely secure. Clients should avoid sending highly sensitive information through ordinary email, text message, social media direct message, public forms, or unsecured channels unless they accept the associated risk.

    When Momentum Coach is retained directly by a client, communications with Momentum Coach are confidential but are not automatically privileged. When Momentum Coach is retained by licensed counsel, or is formally engaged under counsel’s direction for the dominant purpose of assisting legal advice or litigation preparation, privilege may be asserted by the client or counsel where legally available. Privilege depends on applicable law and the facts of the engagement. Momentum Coach does not independently guarantee that any communication, note, report, email, meeting summary, document, or work product will be privileged.

  • Momentum Coach may use third-party service providers for website hosting, scheduling, video meetings, payment processing, email, cloud storage, analytics, forms, document tools, telecommunications, accounting, automation, newsletter management, security, and related operations.

    Service providers may process information in Canada, the United States, or other jurisdictions. Where personal information is transferred to a service provider for processing, Momentum Coach remains accountable for the information under applicable Canadian privacy law and uses contractual, technical, administrative, or other safeguards appropriate to the circumstances.

    Where artificial intelligence tools are used, they are used to support drafting, organization, summarization, administration, or service preparation. They do not replace professional judgment, client instructions, counsel advice, regulated professional advice, or final human review.

  • Momentum Coach services are intended for adults unless a written agreement states otherwise and appropriate legal authority, consent, scope, and safeguards have been confirmed.

    Momentum Coach does not knowingly collect personal information from minors for advisory services without appropriate authorization. Where a matter involves a minor, the requesting adult may be required to confirm legal authority to request services, disclose information, provide documents, and authorize communications.
